Terms & Conditions – SuperDeck

1. Introduction

These Terms and Conditions (“Terms”) govern your use of the SuperDeck website and services. By accessing or using our website or engaging our services, you agree to be bound by these Terms.

If you do not agree, you must not use our website or services.

2. Definitions

• “Company”, “we”, “us”, “our” means SuperDeck.
• “Customer”, “you” means any person or entity using our services.
• “Services” include decking supply, design, installation, quoting, and related services.
• “Website” means https://superdeck.com.au/.

 

3. Scope of Services

SuperDeck provides:

• Decking supply (composite/timber products)
• Decking Accessories
• Design consultation and quoting

All services are subject to availability and acceptance.

 

4. Quotes & Orders

• Quotes are valid for 14 days unless otherwise stated.
• Prices may vary due to:
  • Material cost changes
  • Site conditions
  • Design modifications
• A project is confirmed only upon:
  • Written acceptance, AND
  • Payment of any required deposit

 

5. Pricing & Payment

• All prices are in AUD unless stated otherwise.
• Payment terms:
  • Deposit required before work commences
  • Progress payments may apply
  • Final balance due upon completion
• Late payments may incur interest and/or suspension of services.

 

6. Variations & Changes

Any variation to agreed work must be:

• Requested in writing
• Approved by SuperDeck

Additional costs and time may apply.

 

7. Delivery & Installation

• Estimated timelines are indicative only.
• Delays may occur due to:
  • Weather conditions
  • Material availability
  • Site access issues
• SuperDeck is not liable for delays outside its control.

 

8. Customer Responsibilities

You agree to:

• Provide accurate information
• Ensure site access and readiness
• Obtain necessary council approvals (unless otherwise agreed)
• Ensure safety of pets, children, and property during works

 

9. Product Warranty

Where applicable:

• Products may carry manufacturer warranties
• Example: composite decking may include long-term warranties (e.g., up to 25 years depending on supplier)

SuperDeck does not alter manufacturer warranty terms.

 

10. Australian Consumer Law (ACL)

Nothing in these Terms excludes your rights under the Australian Consumer Law.

You are entitled to:

• Replacement or refund for major failures
• Repair or replacement for minor failures

 

11. Refunds & Cancellations

• Deposits may be non-refundable once materials are ordered
• Cancellation fees may apply for booked projects
• Refunds are subject to ACL obligations

 

12. Intellectual Property

All website content (text, images, designs) is owned by SuperDeck and may not be reproduced without permission.

 

13. Website Use

You agree not to:

• Use the website for unlawful purposes
• Attempt to breach security or functionality
• Copy or misuse content

We may suspend access at any time.

 

14. Limitation of Liability

To the maximum extent permitted by law:

• SuperDeck is not liable for indirect or consequential loss
• Liability is limited to:
  • Re-supply of services, or
  • Cost of re-supply

Similar limitation clauses are standard in Australian T&Cs

 

15. Indemnity

You agree to indemnify SuperDeck against any loss arising from:

• Your breach of these Terms
• Misuse of services or products

 

16. Termination

We may terminate services if:

• Payment is not made
• Terms are breached

All outstanding payments remain due.

 

17. Dispute Resolution

If a dispute arises:

1. Parties must attempt resolution in good faith
2. If unresolved within 21 days, either party may pursue legal action

This staged approach is standard in Australian contracts

 

18. Privacy

Your use of our services is also governed by our Privacy Policy.

 

19. Changes to Terms

We may update these Terms at any time. Continued use of our website or services constitutes acceptance.

 

20. Governing Law

These Terms are governed by the laws of Victoria, Australia.
